AIDMED Sp. z o.o. (“AIDMED”) is committed to protecting the privacy of individuals who visit the AIDMED Web sites (“Visitors”) and individuals associated with organizations who register to use the Services as defined below (“Customers”). This Privacy Policy (the “Statement”) describes AIDMED’s privacy practices in relation to the use of AIDMED’s public Web site (www.aidmed.ai), other AIDMED Web sites made available from time to time, and applications and services offered by AIDMED (collectively, the “Services”) as logged-in user, mobile app user (“User”) and  individuals using Services without log-in (“Visitor”).

In processing Users’ and Visitors’ data, we are guided by the following principles:

– legality, fairness and transparency for the individuals subject to data processing;

– we do not collect more information than we need to provide the services performed by AIDMED;

– we do not use data for purposes other than those mentioned in this Privacy Policy; 

– we do not keep data longer than necessary;

– we process data in a way that ensures adequate security, including protection against unlawful or unlawful processing and against accidental loss, destruction or damage;

– we do not disclose data to third parties other than as set out in this Privacy Policy.

WHO ARE WE?

Aidmed Sp. z o.o. based in Partyzantów 76, Gdańsk 80-254, KRS:0000724567, NIP:5833290208, REGON: 369656602, e-mail address: contact (at) aidmed.ai (“AIDMED”) is the administrator of Users’ and Visitors’ personal data obtained in connection with Users’ or Visitors’ use of the Website or services provided through the Website.

The Services provided, among other things, allow medical entities to provide medical services remotely to their Patients. If a medical service is provided to you by an entity that is our client, the administrator of your personal data will be the medical entities providing medical services (Customer).

Objectives of data collection and use

AIDMED is the owner of the Telemedicine System (Web Service, Mobile Application, Recorder) which is a Class IIa medical device used, among other things, to remotely collect patient vital signs and information about our Customers’ Patients.

– If you use the Website as a Visitor and choose not to create an account on the Website or contact us through the contact forms on our website, we do not process any information about you except for your IP address, which is necessary for technical reasons related to the administration of our servers. However, we are not able to identify you from your IP address alone.

– Data provided when using the contact forms available on the Website are processed in order to respond to the submitted query. The legal basis for processing your personal data is the legitimate interest of AIDMED (i.e. Article 6(1)(f) GDPR) – thanks to this data we will be able to contact you. Providing personal data is necessary to process your inquiry.

– The personal data you provide in the registration form when creating an account at the Site will be processed in order to create your profile, organize the exchange of information between you and AIDMED and other users of the Site according to the principles set out in the Main Terms of Service available at the Site (“Terms of Service”), as well as, if you file a complaint, in order to process it. The legal basis for the processing of your personal data is the agreement concluded with AIDMED for the provision of the Service referred to in the Regulations (i.e. Article 6(1)(b) of the GDPR). Providing personal data is necessary to conclude the agreement. Refusal to provide them or providing incorrect data will make it impossible to use the services offered through the Service.

AIDMED makes the Service available to Customers by entering into a service agreement with them. One way to enter into a contract for the provision of services is to register with the Service by persons authorized to represent the Customer.

– We may also process your personal data for marketing purposes. The legal basis for processing your personal data for this purpose is our legitimate interest i.e. Article 6(1)(f) GDPR), related to marketing our services.

-Your personal data may also be processed in order to establish, defend or assert claims. The basis for processing your personal data for this purpose is our legitimate interest (i.e. Article 6(1)(f) of the GDPR) in protecting Telmedicin’s rights in court or administrative proceedings, and with regard to sensitive data, Article 9(2)(f) of the GDPR . For this purpose, we may process data collected through call or call recording using systems provided by AIDMED. 

– Activity on the Website is recorded in system logs. The information collected in the logs is processed primarily for purposes related to the provision of the Services. AIDMED also processes them for technical and administrative purposes, to ensure IT system security and management, as well as for analytical and statistical purposes – in this regard the legal basis for processing is the legitimate interest of AIDMED (Art. 6 (1)(f) GDPR).

– The Service allows Customers to process your personal data concerning Patients from, among others, mobile devices, pulse oximeter and Aidmed ONE recorder, which are sent to the Service through the AIDMED HEALTH Mobile Application. The administrator of the Patients’ personal data, such as name, surname, individual identification number, e-mail address, telephone number, information on health status in this case is the Customer within the meaning of Article 4(7) of the GDPR, while AIDMED is the processor within the meaning of Article 4(8) of the GDPR.

– In order for the Mobile Application to function properly, the Patient, after downloading the Mobile Application, is asked to grant permission to use background location access to find and connect to the Bluetooth device, even when the application is turned off or not in use. The patient is prompted for the reason the Mobile App requires location permissions. AIDMED does not collect or use the Patient’s location information for purposes other than the Bluetooth connection between the AIDMED HEALTH Mobile App and the AIDMED ONE Recorder, Pulse Oximeter, or other devices that connect with this protocol.

– When the Patient launches the Mobile Application, logs are collected and sent to the AIDMED server of activity in the Mobile Application, the operation of the application, and the operation of connected devices such as the Pulse Oximeter, Aidmed One Recorder.

HOW LONG DO WE KEEP YOUR PERSONAL DATA?

The personal data of which AIDMED is the controller within the meaning of Article 4(7) GDPR will be processed for the duration of the contract for the provision of services or to lodge an effective objection to the processing in cases where the legal basis for the processing is the legitimate interest of AIDMED. The period of data processing may be extended where the processing is necessary for the establishment and assertion of potential claims or defense against claims, and thereafter only if and to the extent required by law.

TO WHOM MAY WE DISCLOSE YOUR PERSONAL DATA?

Your personal data may be disclosed to third parties, including but not limited to IT service and system providers; which are used to provide the services, to payment processors for our services in order to process and fulfill payments for the services; to service providers necessary to send transactional and product information via email or SMS to the extent that disclosure is necessary to automate, simplify and analyze these processes; third party accounting and bookkeeping services to the extent that disclosure is necessary to provide these services to us; legal advisers and consultants to the extent that disclosure is necessary for the use of their services; and governmental, law enforcement and judicial authorities where required by law. In each case, we will endeavour to ensure that the representatives of the aforementioned authorities request disclosure of the data directly to you. If we are required to disclose your information, we will promptly notify you and provide you with a copy of the request, where the law permits us to do so; to healthcare providers and other entities authorized to access your medical records. 

The level of protection for Personal Data outside the European Economic Area (EEA) differs from that provided by European law. For this reason, AIDMED transfers Personal Data outside the EEA only when necessary and with an adequate level of protection.

AIDMED always informs you of its intention to transfer Personal Data outside the EEA at the stage of collection.

We will never sell the Personal Data you provide to us to any third party.

YOUR RIGHTS

Each person whose Personal Data is processed by AIDMED as a controller has the right to access the content of the data and to request rectification, erasure, restriction of processing, the right to data portability and the right to object to the processing of the data, as well as the right to lodge a complaint with the supervisory authority dealing with the protection of Personal Data.

Any person whose Personal Data is processed by AIDMED as a controller has the right to object to data processed on the basis of Article 6(1)(f) GDPR (legitimate interest).

ANALYTICAL TOOLS, NAVIGATIONAL, PROFILING  INFORMATION, COOKIES

Cookies, Web Beacons, and IP Addresses

AIDMED uses commonly-used information-gathering tools, such as cookies and Web beacons, to collect information as you navigate the Site (“Web Site Navigational Information”). We specifically use targeting or advertising cookies (described below) on the AIDMED public Web site(s).

Cookies

AIDMED uses cookies to make interactions with the Services easy and meaningful. When you visit the Services, AIDMED’s servers send a cookie to your computer. Standing alone, cookies do not personally identify you; they merely recognize your Web browser. Unless you choose to identify yourself to AIDMED, such as filling out a “Contact Me” Web form, you remain anonymous to us.

AIDMED uses cookies that are session-based and persistent-based. Session cookies exist only during one session. Targeting or Advertising Cookies

From time-to-time, AIDMED engages third parties to track and analyze Visitors’ navigation of its public Web site usage and volume statistical information from individuals who visit the public Web site. For example, these cookies remember which browsers have visited the public Web site. The information provided to third parties does not include personal information, but this information may be re-associated with personal information after we receive it.

AIDMED may also contract with third-party advertising networks that collect IP addresses and other information from Web beacons (see below) on the public Web site, from emails, and on third-party Web sites. Ad networks follow your online activities over time by collecting Web Site Navigational Information through automated means, including through the use of cookies. They use this information to provide advertisements about products and services tailored to your interests. You may see these advertisements on other Web sites. This process also helps us manage and track the effectiveness of our marketing efforts.

Third parties, with whom we partner to provide certain features on the public Web site or to display advertising based upon your Web browsing activity, may use Flash cookies to collect and store information.  Flash cookies are different from browser cookies because of the amount, type, and how data is stored.

Web Beacons

AIDMED uses Web beacons alone or in conjunction with cookies to compile information about Visitors’ usage of the public Web site and interaction with emails from AIDMED. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular Web site tied to the Web beacon, and a description of a Web site tied to the Web beacon. For example, AIDMED may place Web beacons in marketing emails that notify us when you click on a link in the email that directs you to the public Web site. AIDMED uses Web beacons to operate and improve the public Web site and email communications.

IP Addresses

When you visit the public Web site, we collect your Internet Protocol (“IP”) addresses to track and aggregate non-personal information. For example, AIDMED uses IP addresses to monitor the regions from which Visitors navigate the public Web site.

Links to Other Web Sites

AIDMED occasionally provides links to other entities on the Services for your convenience in locating certain information, services, and products. Please be advised that when you link to these other sites, you are leaving the AIDMED Service(s) and that these third party sites are maintained by organizations over which AIDMED has no control.

Social Media

If you post material to a blog or other social media feed located on or accessed through the Services, you should be aware that any personally identifiable information you submit can be read, collected, or used by other users of these blogs, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these blogs.

Opt-Out

In connection with promotions or other projects, we may ask you specifically whether you have objections against a certain kind of data use or sharing. If you opt-out under such circumstances, we will respect your decision. To opt-out of receiving marketing communications from AIDMED via email please click on the “opt-out” link in the email communication. Please be advised that communications sent by AIDMED via other means are initiated via lists maintained by AIDMED from explicit opt-in scenarios such as website downloads or tradeshows. These lists provide for an opt-out option at the time you submit your information. Please note that our affiliates and other data recipients have their own data privacy policies, which may differ from ours and you would have to contact them separately with respect to opt-out requests.
